Si le travail des enfants est un sujet qui déchaîne les passions, et fait couler beaucoup d’encre, il est en réalité fort peu connu.
Après une brève présentation du travail des enfants dans le monde, la complexité de la résolution de ce problème sera mise en évidence.
Enfin, certaines solutions apportées par le commerce équitable seront présentées. |
Le travail des enfants dans le monde
 elon l’UNICEF, une grande part du travail des enfants se situe dans les fermes et les plantations ou à domicile, et non dans des industries d’exportation (moins de 5%). Il s’agit donc avant tout d’un problème local.
Dans une étude réalisée au Népal, il a été montré que le travail des enfants, dans certaines de ses formes les plus fréquentes (corvées ménagères et travaux agricoles), était favorable au développement de l’enfant [1].
Il serait donc absurde de le diaboliser dans sa globalité.
A ce titre, il est important de distinguer le travail de l’exploitation.
L’UNICEF considère que le travail d’un enfant relève de l’exploitation s’il implique par exemple :
 une rémunération insuffisante
un emploi qui entrave l’accès à l’éducation
un travail à plein temps à un âge trop précoce
des atteintes à la dignité et au respect de soi
un travail qui ne facilite pas l’épanouissement social et psychologique complet... [2]
The awful truth
Devant l’exploitation d’enfants, on pourrait avoir envie de lancer des appels aux boycotts, des pressions internationales fortes pour que cela cesse... mais cela n’est malheureusement pas toujours aussi simple que cela.
En 1992, une loi interdisant l’import de produits fabriqués par des enfants de moins de quinze ans était proposée au sénat américain. La loi n’était pas encore votée qu’une panique a débuté dans l’industrie du vêtement au Bangladesh, entraînant le licenciement d’un grand nombre d’enfants. Une étude a révélé qu’une grande partie de ces enfants avait trouvé une activité plus dangereuse et moins bien payée telle que la prostitution.
Il est donc nécessaire d’avoir l’approche la plus fine, et la plus pertinente possible, afin d’être certain de ne pas détériorer la situation.
Dans le film "The Big One", Michael Moore obtient un entretien avec Phil Knight, PDG de Nike, avec lequel il aborde entre autre, le problème du travail des enfants dans ses usines. Selon les sources de Michael Moore, les travailleurs les plus jeunes sont âgés de 12 ans, ce qui est effectivement très jeune (la loi impose un âge minimum de 14 ans). Etant donné les conditions de travail dans ce type d’usine (sujet non-abordée lors de l’entretien), il est effectivement "malheureux" d’apprendre que des enfants si jeunes y travaillent. Michael Moore demande donc à Phil Knight d’exiger un âge minimum de 16 ans (comme aux Etats-Unis), et Phil Knight refuse.
Apparemment des suites de ce film, Phil Knight céda, et fit passer l’âge minimum des travailleurs dans ses usines de chaussures de sport en Indonésie à 18 ans.
Si ce film est très amusant, et que l’on peut se réjouir de voir que l’opinion publique peut avoir une forte influence sur le comportement des grandes entreprises, on peut se demander ce que sont devenus les enfants qui travaillaient dans ces usines.
Lorsque des associations, telles que le collectif de l’éthique sur l’étiquette militent pour défendre les droits des travailleurs dans les pays du Sud, l’information est essentiellement centrée sur les conditions de travail, et non sur l’âge des employés. Aussi, le boycott est présenté comme une mesure extrême à éviter tant que possible.
D’ailleurs, aussi surprenant que cela puisse paraître, des mouvements d’enfants des Pays en Voie de Développement revendiquent leur droit au travail dans la dignité,
et dans le rapport intitulé "éradiquer les pires formes de travail des enfants",
l’Organisation Internationale du Travail souligne qu’une interdiction pure et simple du travail ne peut suffire à régler le problème, car l’illégalité déclarée peut priver les enfants actifs de la protection qu’accorde la législation du travail aux adultes [3].
Les apports du commerce équitable
Contrairement à ce que l’on pourrait penser, certains organismes de commerce équitable n’interdisent pas de façon systématique le travail des enfants.
L’IFAT par exemple, précise que si jamais des enfants travaillent, leur activité ne doit pas gêner leur bien-être, leur sécurité, leur éducation et leur besoin de jouer, et qu’elle doit être en conformité avec la convention des Nations Unies sur le droit des enfants, et la loi locale.
Par contre, beaucoup d’acteurs du commerce équitable dans le Sud, mettent en place des projets qui permettent d’améliorer la vie de nombreux enfants, et sont parfois en adéquation avec certaines des solutions proposées par l’UNICEF pour lutter contre l’exploitation des enfants (renforcer l’éducation, donner aux pauvres des moyens d’agir, faire campagne pour que les entreprises prennent mieux conscience de leur responsabilité propre et de celle de leurs sous-traitants...).
PREDA, (fondation nominée au prix Nobel de la paix 2001 et 2003),
par exemple, lutte contre l’exploitation infantile (en particulier la prostitution), et a créé :
un centre pour jeunes drogués
une école pour enfants des rues
un centre médical
un centre d’accueil pour enfants abandonnés
une coopérative alimentaire
une charte internationale des droits de l’enfant... [4]
Ces partenaires sont d’ailleurs loins d’être des cas isolés (d’autres organisations proposent des micro crédits, des bourses d’études...), et il est évident que les avantages apportés par le commerce équitable aux parents, sont également bénéfiques aux enfants.
Par exemple, quand la famille Niemar a rejoint l’organisation COMPARTE, ils ont pu payer une éducation décente à leurs trois enfants, ce qui est remarquable au Chili. [5]
